The Case Against Robin Bain

After five hours and 50 minutes of deliberation on 5 June 2009, a Christchurch jury pronounced David Bain not guilty of the murder of his family in one of the country's most sensational murder cases. During the court case David's defence team focused on the potential guilt of David's father Robin, who died at the scene of the crime. And whether or not Robin was responsible for the murders, remains one of New Zealand's biggest unsolved questions. Award-winning documentary film maker Bryan Bruce has spent the last year re-examining evidence from the court case as well as uncovering new sources, to evaluate whether he thinks there is enough evidence to sustain the alleged murder claims against Robin. Bruce explains how his investigation began: "I was out of the country working on another project when the Bain retrial was on, so I applied to the court for all the court camera footage. As a result I have been in the unique position of not only watching the whole trial but being able to rewind and revisit sectionsof the testimony about Robin." "It's clear to me, that while one man - David - was on trial, a second man - Robin - was constantly being judged. It's something that was 'wired in' to the way both Justice Panckhurst and the late Justice Williamson at the 1995 trial framed the 'who dunnit' question for the jury to consider, was it Robin or was it David?" Bruce says. "So the starting point for my investigation isn't the either or scenario put to the court but an investigation that focuses solely on Robin and whether the evidence and argument that he killed all of his family except David can bear some real scrutiny." Bruce explains. Bruce is tight-lipped about where his investigations have led him and what he has concluded but he promises even those viewers who think they've heard everything they ever want to know about the Bain Case, may be stunned by someof the things he has found out.
